Generative AI and cutting-edge technological solutions hold great potential for public-sector administrations as well as private organisation across Europe to improve societal challenges, producing innovation as well as provide better services to the citizens.

The rapid spread of such technologies brings an increasing need for regulation and for defining the terms, conditions and potential risks that buyers need to consider when purchasing AI solutions. The recent Artificial Intelligence Regulatory framework of the European Union highlights the importance of introducing AI systems across the EU which are safe, traceable, non-discriminatory and environmentally friendly.

For this reason, an increasing number of public authorities are regulating the purchase of AI solutions through procurement clauses. Procurement Clauses of Artificial Intelligence allow to define a set of contractual terms for Artificial Intelligence algorithms that public authorities purchase. The Clauses help clarify standards, obligations and responsibilities of public authorities and AI suppliers. For instance, by indicating essential requirements that AI-systems need to respect, such as risk and quality management systems, technical documentation, human oversight indications, compliance and audit measures.

Objective of the session

The objective of this session is to discuss the importance of regulating the development of generative AI solutions, by promoting the tool of procurement clauses of AI. Procurement clauses of AI can hinder the challenges and risks posed by the purchase of AI solutions, by tackling issues of bias, privacy, accountability and transparency.

Living-in.EU, supported by the European Commission and the law firm Pels Rijcken, has organised round tables in which experts have reviewed the proposal for EU model AI clauses. These clauses aim to support contracting authorities in the EU to procure responsible and trustworthy AI in compliancy with the upcoming AI Act.

This workshop will present the latest version of clauses and discuss their adoption EU level, discussing challenges and opportunities for public authorities and business companies.The workshop is organised in partnership with the University of Amsterdam in the context of the Adra-e project.
